In a recent development, the Union Environment Ministry and Adani Realty have informed the Bombay High Court that a 24-acre plot near the Bandra-Worli Sea Link toll plaza is situated outside the Coastal Regulation Zone (CRZ) and is eligible for development. This statement comes in response to public interest litigations (PILs) challenging the allocation of this land to Adani Realty, citing potential violations of CRZ regulations.

The PILs, filed by activist Zoru Bhathena and the Bandra Reclamation Area Volunteers Organisation, argue that environmental clearance for the Bandra-Worli Sea Link was granted under the condition that reclaimed land near the toll plaza would not be used for commercial purposes. They contend that the tender process for land allotment contravenes this stipulation and that CRZ regulations prohibit such development on reclaimed land.

In defense, Adani Realty submitted an affidavit denying all allegations, asserting that the land in question is “completely out” of the CRZ and available for development. The affidavit references an October 2024 report by the Institute of Remote Sensing, Anna University, Chennai, which confirms that the project site falls outside the CRZ as per the approved Coastal Zone Management Plan.

The Union Environment Ministry reiterated in its affidavit that the plot does not fall under CRZ restrictions according to the 2019 CRZ notification, which supersedes previous notifications. Despite these assertions, the Bombay High Court has directed other authorities to submit their affidavits and has emphasized that no construction work should commence until all necessary environmental clearances are obtained.

This case highlights the ongoing tension between urban development and environmental conservation, with significant legal and ecological implications.
