Ketan Kakkad: The NRI Fighter Championing Property Rights and Justice

Ketan Kakkad, a retired Non-Resident Indian (NRI) from the USA, has emerged as a symbol of resilience and the fight for justice against formidable odds. His long-standing property dispute with Bollywood megastar Salman Khan has transformed from a personal battle into a larger conversation about power, influence, and the rights of an ordinary citizen, an America-returned Hindu NRI Senior Citizen Woman, a U.S. Citizen, and his family.

The core of the conflict revolves around 2.5 acres of mountain-top land in Panvel that the Kakkads own, above Salman Khan’s farmhouse, Arpita Farms. Kakkad has maintained that since last 11 years – he and his family are systematically harassed and prevented from accessing their own mountain-top plots, eco-friendly home, and Ganapati Dada Mandir – above Salman Khan’s so-called Arpita Farms, with access roads obstructed and power connections denied by goons, even to a small, eco-friendly Ganapati temple on his land.

NRI Ketan Kakkad fought the defamation case filed against him by Salman Khan who seems to have filed this Defamation Lawsuit as a strategic move to “pressurise him to give up his mountain-top land, eco-friendly home, and Ganapati Mandir.”

In a significant legal victory, the Mumbai Sessions Court in March 2022 dismissed Khan’s petition for an injunction, with the judge noting that Kakkad had “documentary proof to show that he was being restrained from accessing his land” and the Honourable Judge awarded the recovery of “Costs in Cause” from Salman Khan. “Literally a Blank Cheque Award Order in the Judgement by Hon. Judge Shri Laddhad.” Emboldened by this outcome, Kakkad served a staggering Rs. 295 crore legal notice to the actor, demanding costs for the litigation.

Through his struggle, Kakkad has positioned himself as a court-declared whistleblower against illegal land use, massive illegal constructions in the ESZ, and ecological violations, standing his ground despite what he describes as a campaign of character assassination and digital censorship under the guise and cover of a defamation suit. “First, the evils used: misused some Forest Dept. Panvel Employees as private goons. Next – use / misuse of State-provided Y or Z Security Policemen as Goons stationed in and around so-called Arpita Farms and on and around Kakkad’s Plots, Home and Temple.

Misuse of the Judiciary System process in the form of a defamation Lawsuit against NRI Ketan Kakkad – to systematically use words in Court to do Ketan Kakkad’s Character Assassination was / is one more step to silence NRI Ketan Kakkad and to continuously keep encroaching on more Forest Land and continue with Further Massive Illegal Constructions of Mega Compound walls with Big Spiral fences on top. Inspite of Crystal Clear Court Order – Salman Khan and family kept doing Forest Offences (as recent and as late as in August 2022) even while this Case hearing was going on in Mumbai High Court. This was / is as good as Slaps and Complete disregard and disrespect on the face of our PM, Law, Order and Justice System.”

It is also noted that Smt. Anita Ketan Kakkad has filed a Petition in the NGT (after obtaining an Order from the Supreme Court) to demolish Illegal Constructions by Salman Khan and his family.

Ketan Kakkad interestingly pointed out that Salman Khan and family (Arpita Farms) are habitual offenders and that Salman Khan is on multiple bails in various cases, including one wildlife case ongoing since 1999 in Panvel Criminal Court against Salim Khan and others.

His fight has come to represent the challenges faced by common individuals when confronting immense celebrity power and influence. As (NRI) Kakkad himself stated, “This case is no longer just about me / us. It’s about Desh, Dharma, Our next Generation, the Larger Public Interest, and humanity.
