A Mulund court has issued a non-bailable arrest warrant against Nirmal Lifestyle director Rajeev Jain for repeatedly ignoring summons in a cheating case over a stalled Kalyan housing project. The court rebuked Mulund police for failing to execute earlier warrants, highlighting concerns over real estate fraud enforcement and senior citizen protection.
A metropolitan magistrate’s court in Mulund has issued a non-bailable arrest warrant against Rajeev Jain, director of Nirmal Lifestyle, after he repeatedly ignored court summons in a high-profile cheating case linked to an unfinished housing project.
The court also delivered a stern rebuke to the senior inspector of Mulund police, holding him accountable for failing to execute earlier warrants and for not filing any compliance report.
Magistrate Slams Police Over Non-Execution of Warrant
According to court records, Jain was issued a bailable warrant on January 28, 2025. However, he failed to appear before the court, and no explanation was provided by the investigating officer.
“Till date, no report is submitted on record. It appears that the investigating officer has not complied with the order passed by this court,” the magistrate stated, underscoring the lack of urgency shown by the police.
The Sprouts News Investigation Team (SIT) notes that such judicial reprimands against law enforcement in high-value real estate fraud cases are increasingly drawing public and policy attention.
Senior Citizen’s Struggle in the Nirmal Lifestyle Housing Dispute
The case originates from a 2016 flat booking in Kalyan by complainant Juliana D’Souza, a senior citizen. She alleges that Nirmal Lifestyle’s project stalled, leaving hundreds of buyers without possession of their homes.
D’Souza finally approached the court in early 2024, assisted by Thane-based social activist Melwyn Fernandes. Her complaint resulted in a cheating case under the Maharashtra Ownership of Flats Act (MOFA), 1963, a statute designed to protect flat purchasers from exploitation by developers.
Petition Highlights ‘Grave Hardship’ and Homelessness
In her petition dated May 14, 2024, advocate Sunita Banis accused Rajeev Jain of “deliberate non-compliance” and urged the court to issue a non-bailable warrant. She emphasised that her client, a vulnerable senior citizen, had suffered “grave hardship, including homelessness” as a direct result of the accused’s unlawful acts.
The Sprouts News Investigation Team (SIT) has learned that multiple homebuyers from the same project have expressed willingness to come forward with similar allegations, potentially widening the scope of legal action.
Broader Implications for Real Estate Accountability
This development once again raises questions about real estate sector accountability, police efficiency in executing judicial orders, and the protection of senior citizens in property disputes. Experts note that under MOFA, developers are legally bound to deliver flats within agreed timelines and can face criminal prosecution for violations.
The Sprouts News Investigation Team (SIT) continues to monitor the case for updates, including whether the warrant will be executed promptly and if additional charges may be filed.
