Senior journalist and RTI activist Ketan Tirodkar has submitted a detailed representation to the Maharashtra Government seeking action against Ricky’s Bar & Kitchen in Hiranandani Estate, Thane, alleging multiple legal and regulatory violations. The complaint states that a Public Interest Litigation (PIL) will be filed before the Bombay High Court if authorities do not initiate action within 30 days.

According to the representation, Tirodkar has requested permanent sealing of Ricky’s Bar & Kitchen, demolition of alleged unauthorised structures, and appropriate legal proceedings. He stated that failure by authorities to act within 30 days would result in a Public Interest Litigation before the Bombay High Court.
The representation identifies the Chief Minister of Maharashtra, senior police officials, officers of the Thane Municipal Corporation, Kasarvadavali Police, and the State Excise Department as proposed respondents if, according to the complaint, administrative authorities fail to take effective action.
Representation cites BNS provisions and seeks criminal investigation
The complaint requests registration of criminal cases under several provisions of the Bharatiya Nyaya Sanhita (BNS), 2023, arguing that the allegations extend beyond regulatory concerns and require investigation by competent authorities under applicable criminal law.
According to the representation, BNS Sections 270 and 271 have been invoked alleging public nuisance arising from late-night liquor service, excessive noise, and disturbance to nearby residents living around the commercial establishment.
The representation also cites BNS Section 292, alleging obstruction of public pathways through the placement of tables and chairs on footpaths, thereby restricting pedestrian movement and causing inconvenience to members of the public.
Further, the complaint invokes BNS Section 125, alleging unauthorised structural alterations involving removal of internal walls across multiple commercial units. According to the representation, these modifications may have affected structural safety and emergency fire access.
The representation additionally refers to BNS Section 223, alleging continued commercial operations despite notices issued by competent authorities, and BNS Section 61, alleging criminal conspiracy involving public officials who, according to the complaint, failed to discharge statutory responsibilities.

Food safety, licensing and regulatory compliance questioned
Apart from criminal allegations, the representation raises several regulatory concerns relating to liquor licensing, food safety, public health, municipal permissions and public safety. These allegations remain unverified and have not been adjudicated by any competent court.
According to the complaint, an open-air bar is allegedly operating on public footpaths contrary to applicable State Excise licensing conditions. The representation also questions whether commercial activities have extended beyond the establishment’s approved licensed premises.
A major issue raised concerns a kitchen allegedly operating on the first floor without approval under the Food Safety and Standards Authority of India (FSSAI) licence. The representation urges authorities to verify whether the kitchen is duly licensed and compliant with applicable food safety regulations.
The complaint specifically questions the scope of FSSAI Licence No. 20210727102689349, alleging that food preparation and service may have extended beyond authorised licensed premises. These allegations have not been independently verified and remain subject to investigation by competent authorities.
The representation further raises concerns regarding alleged public drinking, disorderly conduct and incidents said to affect the safety, convenience and security of nearby residents, including women. These assertions also remain unverified pending official examination.
Enforcement sought as PIL warning issued
The representation seeks cancellation of liquor and food licences, demolition of alleged illegal encroachments and unauthorised structural alterations, sealing of the premises, including any allegedly unauthorised liquor storage areas, and criminal proceedings against those found responsible in accordance with law.
Describing the representation as a “Legal Ultimatum,” Ketan Tirodkar stated that if the concerned authorities fail to initiate appropriate action within 30 days, he intends to file a Public Interest Litigation before the Bombay High Court seeking judicial oversight and accountability.
