Cloud 9 Beverages Water Supply Row: RTI Raises Questions Over Alleged Unauthorised Water Tankers From GIP Dam in Ambernath MIDC
RTI replies obtained by activist Sudhir Sharad Gujar have triggered demands for an investigation into M/s Cloud 9 Beverages after MIDC reportedly stated it had not granted permission for private tanker water supply to the company’s manufacturing unit in Additional Ambernath.
The Cloud 9 Beverages water supply controversy has drawn attention after information obtained under the Right to Information Act, 2005, reportedly indicated that Maharashtra Industrial Development Corporation (MIDC) had not granted permission for the company to receive water through private tankers from external sources, including the GIP Dam.
According to documents obtained by RTI activist Sudhir Sharad Gujar, M/s Cloud 9 Beverages, located at Plot No. K-29 in the Additional Ambernath MIDC industrial area, allegedly received water through private tankers without obtaining the necessary approval from MIDC. The allegations have prompted demands for a detailed administrative inquiry and appropriate legal action.
RTI Reply and MIDC Clarification
The RTI application filed by Sudhir Sharad Gujar under the Right to Information Act, 2005, sought details regarding permissions granted to the company for procuring water from external private tanker operators.
In its written reply, Maharashtra Industrial Development Corporation (MIDDC) reportedly stated that Cloud 9 Beverages had not been granted any official permission or No Objection Certificate (NOC) to transport water to its plant through private tankers from the GIP Dam or any other outside source.
The RTI response further reportedly stated that the company had not been authorised to procure water through external tanker supply, nor had any limits or permissions for such transportation been approved by the corporation.
The RTI disclosures have intensified scrutiny over whether any external water extraction and transportation, if undertaken, complied with applicable regulations governing industrial water usage and natural resources.

MIDC Notices and Alleged Continued Tanker Operations
According to the complainant, local villagers raised objections regarding the alleged tanker movement, following which MIDC issued notices dated June 2, 2026, and a reminder dated June 5, 2026, directing the concerned plot holder to immediately stop the tanker-based water supply.
However, the complainant has alleged that tanker operations continued on June 3, 2026, and thereafter despite the notices, raising questions regarding compliance with administrative directions and enforcement by the concerned authorities.
The allegations have not been independently verified by Sprouts News, and no official finding determining liability has been publicly announced at the time of publication.
Legal Provisions Cited by the Complainant
The complainant has argued that, if the allegations are substantiated during investigation, provisions of the Bharatiya Nyaya Sanhita, 2023 (BNS) could become relevant.
These include Section 303 (Theft) relating to alleged unauthorised removal of public property or natural resources, Section 61 (Criminal Conspiracy) where evidence establishes coordinated illegal activity, Section 324(4) (Cheating) relating to alleged wrongful gain through deception, and Section 223, concerning alleged disobedience of lawful orders issued by a public servant.
Legal experts note that the applicability of any criminal provision would ultimately depend upon the findings of the competent investigating agency and subsequent judicial proceedings.
Complaint Forwarded for Further Action
According to official correspondence, the MIDC Sub-Engineer’s Office, through communication Ja. Kr./Up Abhi./I-177323/2026 dated June 19, 2026, reportedly forwarded the complaint to the authorities concerned with the GIP Railway Dam, Kakole Village, Ambernath, for further examination and appropriate action.
The complainant has demanded registration of an FIR, investigation into the alleged involvement of all responsible persons, and immediate sealing of the industrial plot if violations are established in accordance with law.
The matter remains under administrative consideration. Any determination regarding alleged unauthorised water extraction, criminal liability or regulatory violations will depend upon the outcome of inquiries by the competent authorities. Sprouts News will update readers if responses are received from Cloud 9 Beverages, MIDC, or other concerned authorities regarding the allegations.
