Why did DLF get a ‘clean chit’ in the Robert Vadra deal? The Magic of Electoral Bonds

Congress leader Sonia Gandhi’s son-in-law and Priyanka’s husband, Robert Vadra, has donated Rs.170 crore to the BJP for party funds through electoral bonds, as revealed by the ‘Sprouts’ Special Investigation Team.

Data from electoral bonds recently released by the Election Commission reveals that DFL, a real estate group, donated Rs 170 crore to the BJP. It kept giving the party money through 2020, 2021 and 2022, making the last round of donations through bonds purchased in November 2022.

The group did not donate electoral bonds to any political party besides the BJP. Three companies purchased these bonds: DLF Commercial Developers Limited, DLF Garden City Indore Private Limited, and DLF Luxury Homes Limited are the names of these three companies.

The Lok Sabha elections campaign is currently in full swing, but it appears that the situation has calmed down at least for a while due to the magic of electoral bonds.

What is the matter?

In the Lok Sabha election campaign of 2014, the BJP heavily criticized Robert Vadra. Allegedly, Vadra amassed wealth of Rs 300 crore on a capital of only Rs. 1 lakh during the economic recession in India. Not only this but also released a booklet titled “Damad Shree: The Vadra ‘get-rich-quick’ model”.

The book questioned the Rs 8 crore transaction between Vadra and DFL. Capitalizing on this point, the BJP also took power from Congress.

The matter did not stop there. Ashok Khemka, who exposed Vadra’s affair, was appointed directly to the Prime Minister’s Office immediately after Narendra Modi became Prime Minister. After that, the matter was further heated. The matter was heated further after that.

The case file was reopened in 2018. The Haryana Police registered a case against Vadra and top officials of the DFL group on September 1. They were charged with criminal conspiracy, forgery, fraud, and the Prevention of Corruption Section. Of course, here too, the BJP was successful in heating the atmosphere on this issue for the Lok Sabha elections.

In January 2019, a new case of land allocation by this company came to light. Irregularities were alleged in this transaction. At that time, the Central Bureau of Investigation (CBI) also searched the DLF offices.

Five years later, however, the case took a different turn. The BJP government made a separate disclosure in the Punjab and Haryana High Court on 19 April 2023. It was said that there was no violation of any rules in this deal (2012 land deal).

But even after this, Vadra and DFL company were not satisfied. The case went to court. the BJP government denied that its submission before the High Court was a “clean chit” for him or the DLF group. Not only this, the government also highlighted the formation of a new Special Investigation Team or SIT to probe the case further.

In November 2023, the High Court complained that the investigation into the case has been ‘crawling since the last five years ‘ and should be completed ‘at the earliest’.

काँग्रेस नेते सोनिया गांधी यांचे जावई व प्रियंका यांचे पती राबर्ट वाड्रा यांनी चक्क भाजपला १७० कोटी रुपयांची देणगी (party fund) इलेक्टोरल बॉण्ड्सच्या माध्यमातून दिलेली आहे, अशी खळबळजनक माहिती ‘स्प्राऊट्स’च्या स्पेशल इन्व्हेस्टीगेशन टीमच्या हाती आलेली आहे.

निवडणूक आयोगाने नुकत्याच जाहीर केलेल्या इलेक्टोरल बॉण्ड्समधील डेटावरून स्पष्ट होते की, DFL या रिअल इस्टेट ग्रुपने ऑक्टोबर 2019 ते नोव्हेंबर 2022 दरम्यान भाजपला १७० कोटी रुपयांची देणगी दिलेली होती. नोव्हेंबर २०२२ मध्ये खरेदी केलेल्या देणगीची शेवटची फेरी केली.

DFL ने इलेक्टॉरेल बॉण्ड्सच्या माध्यमातून केवळ भाजपलाच देणगी दिल्याचे आढळते. अन्य इतर कोणत्याही पक्षाला या बॉण्ड्सद्वारे देणगी देण्यात आलेली नव्हती.

१७० कोटी रुपयांचे हे बॉण्ड्स तीन कंपन्यांनी खरेदी केलेले आढळून आलेले आहेत. डीएलएफ कमर्शियल डेव्हलपर्स लिमिटेड (DLF Commercial Developers Limited), डीएलएफ गार्डन सिटी इंदूर प्रायव्हेट लिमिटेड (DLF Garden City Indore Private Limited), डीएलएफ लक्झरी होम्स लिमिटेड (DLF Luxury Homes Limited) ही या तीन कंपन्यांची नावे आहेत.

प्रकरण तात्पुरते शांत:
सध्या लोकसभेच्या निवडणुकीचा प्रचार धुमधडाक्यात चालू आहे. इलेक्टोरल बॉण्ड्सची जादू आहे, त्यामुळे का होईना सध्या तरी हे प्रकरण शांत झाल्याचे आढळून येत आहे.

काय आहे प्रकरण?

सन २०१४ च्या लोकसभेच्या प्रचारात भाजपने वाड्रा (Robert Vadra ) यांच्यावर प्रचंड टीका केली. भारतात आर्थिक मंदी असताना वाड्रा यांनी केवळ १ लाख रुपयांच्या भांडवलावर ३०० कोटी रुपयांची माया गोळा केली, असा आरोप केला. इतकेच नव्हे तर “दामाद श्री: The Vadra ‘get-rich-quick’ model” अशी पुस्तिकाही काढली. या पुस्तकात वाड्रा व DFL या कंपनीने केलेला ८ कोटी रुपयांचा व्यवहार यावर प्रश्नचिन्ह उपस्थित केले. या मुद्याचे भांडवल करीत भाजपने काँग्रेसकडून सत्ताही खेचून घेतली.

प्रकरण यावरच थांबले नाही. नरेंद्र मोदी सत्तेवर येताच वाड्रा यांचे हे प्रकरण उघडकीस आणणाऱ्या अशोक खेमका या IAS अधिकाऱ्याची वर्णी थेट पंतप्रधान कार्यालयात करण्यात आली. त्यानंतर हे प्रकरण आणखी तापवण्यात आले.

सन २०१८ मध्ये या केसची फाईल पुन्हा उघडण्यात आली. हरियाणा पोलिसांनी वाड्रा व DFL या ग्रुपचे उच्च अधिकारी यांच्याविरोधात १ सप्टेंबर रोजी गुन्हे दाखल केले. त्यांच्यावर गुन्हेगारी कट, बनावटगिरी, फसवणूक आणि भ्रष्टाचार प्रतिबंधक कलम यांसारखे चार्जेस लावण्यात आले. अर्थात इथेही लोकसभेच्या निवडणुकीसाठी याच मुद्यावर वातावरण गरम करण्यात भाजप यशस्वी ठरले.

जानेवारी २०१९ मध्ये, या कंपनीचे जमीन वाटपाचे नवे प्रकरण उघडकीस आले. या व्यवहारात अनियमितता असल्याचा आरोप करण्यात आला. त्यावेळी केंद्रीय अन्वेषण ब्यूरोने DLF कार्यालयांची झडतीही घेतली.

पाच वर्षानंतर मात्र या प्रकरणाला वेगळीच कलाटणी मिळाली. भाजप सरकारने १९ एप्रिल २०२३ मध्ये पंजाब आणि हरियाणा उच्च न्यायालयामध्ये वेगळाच खुलासा केला. या व्यवहारात (सन २०१२ च्या जमीन व्यवहारात) कोणत्याही प्रकारच्या नियमांचे उल्लंघन झाले नसल्याचे सांगितले.

मात्र यानंतरही वाड्रा व त्यांच्या DFL कंपनीचे समाधान झाले नाही. प्रकरण न्यायालयात गेले. मात्र तेथे त्यांना ‘क्लीन चिट’ मिळाली नसल्याचे भाजप सरकारने सांगितले. इतकेच नव्हे तर सरकारने या प्रकरणाच्या पुढील तपासासाठी नवीन विशेष तपास पथक किंवा एसआयटी स्थापन केल्याचे अधोरेखित केले.

नोव्हेंबर 2023 मध्ये, उच्च न्यायालयाने तक्रार केली की, या प्रकरणाचा तपास ‘गेल्या पाच वर्षांपासून रेंगाळत आहे’ (crawling since the last five years) आणि ‘लवकरात लवकर’ पूर्ण केला जावा.
