Thane Court Dismisses Suit Challenging TMC Demolition

According to information provided by Bauva’s legal team, the Thane civil court dismissed litigation seeking to restrain TMC from proceeding against allegedly unauthorised structures on the disputed gaushala property.

The dismissal followed submissions by the municipal corporation and an intervention on behalf of Bauva by his recently appointed legal counsel, Advocate Sunita Banis.

Banis intervened in the proceedings to protect Bauva’s claimed property interests and support the continuation of lawful municipal action against the disputed construction.

TMC had initiated statutory proceedings during February and March 2026 under applicable municipal and town-planning legislation after concerns emerged regarding allegedly unauthorised structures.

The matter also involves FIR No. 477 of 2026, reportedly concerning alleged violations of the Maharashtra Regional and Town Planning Act (MRTP Act).

While the dismissal removes an immediate legal obstacle arising from the suit, subsequent demolition proceedings remain subject to applicable statutory requirements and other subsisting judicial directions.

Ganesh Chaudhari Confirms Immediate Demolition Action

Speaking to The Sprouts News, Assistant Municipal Commissioner Ganesh Chaudhari said the Vartak Nagar civic administration intends to take immediate action against the unauthorised structures.

His statement indicates the administration’s intention to proceed with municipal enforcement in a dispute involving allegedly illegal construction, contested property occupation and animal welfare concerns.

Implementation will require compliance with applicable legal procedures, administrative coordination and appropriate police arrangements to maintain law and order during enforcement.

The disputed structures are situated on land identified as Gut Nos. 7/12 and 7/13 at Yeoor, according to details provided by Bauva’s representatives.

Bauva alleges that portions of the property remain occupied by individuals without lawful authority, although the competing possession claims require examination of relevant records.

Alleged September 2025 Attack Disrupted Shelter for Over 100 Cows

The controversy intensified following an alleged incident on September 30, 2025, when Bauva claimed several individuals forcibly entered the premises and interfered with possession.

According to his complaint, the incident involved intimidation, damage to cattle shelters and disruption of facilities used to care for abandoned and stray cows.

Following the alleged incident, FIR/CR No. 780 of 2025 was registered at Vartak Nagar Police Station on October 10, 2025.

Earlier reporting by journalist Anamika Gharat identified allegations involving members of the Dhangad and Baraf families and approximately 20 to 24 other individuals.

Bauva also alleged that 17 cows died following the disruption and another 13 went missing, although these claims require independent verification.

The property dispute has reportedly forced more than 100 cattle into difficult shelter conditions, raising concerns about animal welfare and the responsibilities of authorities.

Decades-Old Property History Complicates Yeoor Dispute

The property’s history reportedly includes a 99-year arrangement dating to 1967 involving Mahendrakumar Manishankar Dave and subsequent dealings concerning the Yeoor Gram Panchayat.

Bauva maintains that he obtained possession through a registered arrangement in 2004 and subsequently operated the premises as a shelter for abandoned cattle.

Earlier reporting also referred to Provident Investment Co Ltd, the Union government, Bombay High Court proceedings and financial settlements involving the Dhangad and Baraf families.

These historical claims require examination of the relevant agreements, revenue records and judicial decisions before definitive conclusions regarding ownership and lawful possession can be established.

Social Activist Melwyn Fernandes Welcomes Court Development

Thane-based social activist Melwyn Fernandes welcomed the reported dismissal and expressed hope that authorities would protect the gaushala while ensuring accountability through lawful proceedings.

Fernandes said Bauva approached him for assistance on September 30, 2026, bringing concerns about the disputed property and the welfare of cattle to his attention.

He also emphasised the religious significance of cows in Hindu tradition and called for appropriate action against anyone found responsible for unlawful activities.

Earlier, the names of certain Adivasi individuals were allegedly entered illegally into the property’s land records. However, the Maharashtra government recently deleted those entries and restored the name of the original owner, Kantilal Manilal Bauva, in the official revenue records.

The reported court development and TMC’s assurance of immediate action represent significant developments, although questions concerning possession, construction permissions and alleged criminal conduct remain unresolved.

The incident of September 30, 2025, has seen renewed momentum following the recent appointment of Advocate Sunita Banis, who has initiated rigorous and persistent follow-up action on behalf of Shri Kantilal Manilal Bauva. These sustained efforts have finally led to positive developments in the matter, raising fresh hopes that the Thane Municipal Corporation is now prepared to discharge its statutory duties and proceed with the demolition of the unauthorised structures in accordance with the law.

With Ganesh Chaudhari confirming the administration’s intention to act immediately, attention now turns to TMC’s enforcement preparations, compliance with court directions and protection of the cattle.
