12 February 2011 – Demolition of Existing Construction
According to records and allegations, a circular issued to society members on 12/02/2011 reportedly stated that construction carried out by Vaidehi Akash was demolished at an estimated cost of approximately ₹40 crore.
It is alleged that following the demolition, redevelopment planning and implementation were redesigned and controlled according to the commercial convenience and interests of Rustamjee Developers. Questions have reportedly been raised regarding the authority under which demolition decisions were undertaken, the financial consequences caused to stakeholders, and whether redevelopment processes were manipulated to benefit private entities at the expense of lawful redevelopment rights.
26 December 2011 – Disputed MHADA NOC Allegedly Issued Without Authorisation
One of the earliest major allegations concerns an Occupation / No Objection Certificate allegedly issued on 26/12/2011 by MHADA’s Building Proposal Department in favour of Rustamjee Developers.
According to complaints and documents referred to in representations before authorities, the NOC was allegedly issued without the consent, authorisation, or participation of Vaidehi Akash, despite redevelopment rights and land interests allegedly belonging to Vaidehi Akash.
It has been alleged that this disputed approval enabled Rustamjee Developers to proceed with redevelopment activities, financial transactions, project execution, and commercial exploitation of redevelopment rights without lawful authorisation from concerned stakeholders.
25 May 2012 – Alleged Manipulation of Commencement Certificate
Another serious allegation concerns a Commencement Certificate reportedly issued on 25/05/2012 after Miti Designers & Planners allegedly informed MHADA authorities that the earlier certificate issued to Vaidehi Akash had been “lost” or “destroyed.”
According to allegations made in complaints and representations, a fresh backdated Commencement Certificate was allegedly issued in the name of Rustamjee Developers by replacing the developer’s name within official records.
The allegations further claim that the process involved manipulation of government documentation, misuse of official authority, fraudulent alteration of redevelopment permissions, and unauthorised transfer of redevelopment rights.
23 July 2012 – Alleged Illegal Mortgage and SBI Loan Transaction
Documents further allege that on 23/07/2012, Rustamjee Developers mortgaged MHADA redevelopment documents and NOC papers to the State Bank of India without obtaining mandatory approvals from MHADA.
According to the allegations, the disputed documents were allegedly used to secure financial facilities and loans amounting to approximately ₹250 crore connected with redevelopment financing and project-related commercial activities.
Complaints additionally allege that the overall financial benefit allegedly derived from the redevelopment project reached nearly ₹4,560 crore, while the actual investment allegedly made by the developer remained substantially lower.
22 August 2012 – Disputed NOC Issued by MHADA Executive Engineer
Another disputed MHADA NOC was allegedly issued on 22/08/2012 by MHADA Executive Engineer Mr. Rama Mitkar without granting Vaidehi Akash an opportunity to present objections or participate in proceedings.
According to allegations, mandatory due process procedures were bypassed, pending disputes were ignored, and mortgage-related permissions were allegedly approved without proper verification or lawful compliance.
Questions have also reportedly been raised regarding the role of concerned MHADA officials and whether redevelopment approvals were granted in violation of established procedures.
Alleged Commercial Exploitation of Public Parking Land
The complaint further alleges that approximately 1,500 square meters of land reserved for public parking, resident convenience, and government-related usage was commercially exploited during redevelopment implementation.
According to allegations, residential flats were allegedly constructed on the reserved land, while two-level basement and podium parking facilities were commercially sold for profit.
Records reportedly indicate that nearly 1,100 parking spaces were sold commercially, allegedly generating financial gains estimated at approximately ₹275 crore. The complaint additionally alleges that flats constructed on reserved public parking land generated commercial benefits estimated at nearly ₹1,200 crore.
According to the allegations, despite the alleged commercial exploitation of public land resources, no premium, compensation, or financial recovery was allegedly paid to MHADA, MCGM, or concerned government authorities.

Alleged Unauthorised FSI Transactions
Documents further allege that Rustamjee Developers entered into agreements involving approximately 50,000 square feet of FSI allegedly belonging to Vaidehi Akash through arrangements involving federation office bearers.
Questions have reportedly been raised regarding ownership rights, authorisation for transfer, legality of monetisation, and the financial benefits allegedly obtained through disputed redevelopment agreements.
11 March 2014 – Letter Before MHADA Vice President Raises Additional Allegations
A letter reportedly submitted on 11/03/2014 before MHADA’s Vice President allegedly stated that Miti Designers & Planners and associated entities submitted disputed and allegedly manipulated documents before authorities.
According to allegations, those documents were allegedly used to secure Intimation of Disapproval (IOD) permissions and Commencement Certificates connected with redevelopment implementation.
EOW Investigation, SIT Proceedings, and Court Intervention
Serious concerns have also emerged regarding the handling of the criminal investigation connected with the redevelopment controversy.
According to records and allegations, on 08/05/2018, EOW Investigating Officer Mr. Bajrang Parab reportedly investigated the matter and recommended the arrest of all 11 accused persons connected with the case.
However, allegations claim that despite the recommendation for arrest, then DCP Parag Manere allegedly failed to take action, leading to intervention by the High Court, Mumbai.
According to the allegations, the Hon’ble High Court subsequently constituted a Special Investigation Team (SIT) to examine the matter. The SIT later reportedly filed a B Summary before the Court of the Additional Chief Judicial Magistrate, 47th Court, Esplanade.
A protest application was thereafter filed before the Magistrate’s Court challenging the B Summary report. For speedy disposal and proper adjudication, a petition was subsequently moved before the High Court seeking expeditious hearing of the proceedings.
According to records referred to in the complaint, the High Court directed the Magistrate’s Court to decide the matter before 30/11/2025.
Following detailed hearings, the Magistrate’s Court, by order dated 30/10/2025, reportedly rejected the B Summary and returned the matter to the Economic Offences Wing for further investigation.
The development has reportedly intensified demands for accountability, independent forensic examination of records, and an investigation into alleged suppression of criminal proceedings.
07 November 2025 – Demand for Cancellation of Allegedly Fraudulent Commencement Certificate
According to records, on 07/11/2025, a formal letter was reportedly addressed to the MCGM Commissioner seeking cancellation of the allegedly fraudulent Commencement Certificate No. CE/8871/WS/AK dated 28/03/2008.
The complaint alleged that the certificate had been issued by former Executive Engineer Mr. Deshpande in favour of Rustamjee Realty.
The representation reportedly demanded scrutiny of the legality of the certificate, verification of supporting documents, and examination of the role of officials involved in the issuance of the disputed redevelopment permissions.
