Over 1,500 residents of a Mumbai housing society have filed a criminal complaint alleging health risks, data concealment, and negligence, triggering legal scrutiny under Bharatiya Nyaya Sanhita provisions.
The Kanakia Paris water contamination case has come into focus after residents formally approached Mumbai Police, alleging prolonged exposure to unsafe water and suppression of critical test reports by management entities.
According to documents reviewed by Sprouts News, the complaint dated January 24, 2026, was submitted to Shri Manish Kalwania, Deputy Commissioner of Police, Zone VIII, and the Senior Inspector of Kherwadi Police Station.
Residents of Kanakia Paris Cooperative Housing Society Limited, located at Bandra Kurla Complex, Mumbai, have accused M/s Godrej Living Private Limited and M/s Zipgrid Proptech Private Limited of endangering public health under instructions from the 9-10 Committee Members, who instructed hiding details as per the official SGM Minutes of Meetings. SGM further ruled to conduct a Section 83 Enquiry and pass a Section 88 through the Registrar. Registrar has ordered a Section 83 Enquiry based on SGM Minutes and a representation made by a few residents, as well as the Administrator’s findings of wrongful acts of the Managing Committee of Kanakia Paris
Society profile and management responsibilities under scrutiny
Kanakia Paris CHS Limited comprises seven 20-storey buildings with 469 units, including 464 residential and five commercial establishments, situated at CTS 629, F Block, Bandra East.
Godrej Living, serving as the property manager, is responsible for facility management, water systems, security, and maintenance operations, while Zipgrid handles finance, compliance, and administrative coordination functions.
Named individuals include Deepanjali Ugale, Community Lead at Godrej Living, and Dinesh Thakur, Society Manager representing Zipgrid, both cited as key contact persons in the complaint. Both were instructed by the Managing Committee to hide details of contamination and critical societal data.
Water contamination findings and alleged concealment of STP-related issues.
The complaint states that water testing conducted on October 30, 2025, across 24 locations revealed contamination in 10 sites, with the presence of E. coli bacteria rendering the water unsafe for consumption. This is the same contamination which remained unsolved at KP for 14 months. Allegedly, STP Plants contamination is at play, and the Managing Committee is unmixing STP pipes from domestic and buying time to hide this criminal negligence. Residents allege that these findings were not disclosed immediately and were only shared in January 2026 following repeated follow-ups, raising concerns about delayed communication and transparency. Despite the contamination known since March 2025, the Managing Committee was shielded by SRA Co-op Registrar Mr Abhijit Patil under pressure from Builders to protect a Builder Friendly managing committee.
Further, it is claimed that fresh tests conducted between January 6 and January 11, 2026, after tank cleaning, were selectively circulated, presenting only clean reports dated January 12, 2026.
This, residents argue, created a “false impression of safety” while earlier contamination data remained undisclosed, amounting to alleged intentional concealment and criminal negligence.
Health impact and infrastructure neglect allegations
From March 2025, residents reportedly experienced foul-smelling water and waterborne illnesses, with nearly 50% of households affected and several individuals requiring hospitalisation.
The complaint also highlights that water tanks were allegedly not cleaned for approximately 18 months despite formal handover obligations, indicating potential lapses in maintenance and contractual compliance.
It further states that information dissemination to tenants and commercial units, including an Indian Bank branch within the premises, was absent, putting a lot of Mumbaikars at risk.

Email trail and internal communication evidence cited
Email communications submitted as evidence include correspondence involving Mitesh Shah, Deepanjali Ugale, Manish Shrirao, Devyani Dalvi, and Sachin Kakad, identified as Kanakia Paris Administrator, appointed by Ms Sandhya Bawankule, removing the dishonest Managing Committee.
In one email dated January 23, 2026, Ugale reportedly shared water testing reports after payment confirmation, while residents sought urgent disclosure of all 24 reports to members.
Another communication dated January 21, 2026, raised concerns that Rs. 12,500 had been paid for testing, yet reports were not shared, prompting questions on accountability and internal processes.
Legal provisions invoked and constitutional claims
Residents have invoked multiple provisions under the Bharatiya Nyaya Sanhita, including Section 61 (criminal conspiracy), Section 125 (endangering life), Section 238 (false representation), and Section 318 (cheating).
Additional sections cited include Section 316 (criminal breach of trust) and Section 336 (forgery), with the complaint asserting violation of Article 21 of the Constitution of India.
The petition argues that the alleged actions compromised residents’ fundamental right to life, clean water, and safe living conditions, raising serious public health concerns.
Residents seek FIR, arrests, and municipal intervention
In their prayer, residents have requested immediate registration of an FIR against both companies and their officers, along with identification and arrest of responsible individuals esp. those Managing Committee Members named in SGM openly, duly recorded in SGM MINUTES.
They have also sought directions to municipal authorities, particularly the Brihanmumbai Municipal Corporation (BMC), to certify the safety of water systems pending investigation.
The complaint is supported by enclosures including water test summaries, delayed report disclosures, and email communications documenting internal exchanges and alleged lapses.
Multiple complainants and claims of inaction
More than 21 society members reportedly approached the police station regarding the issue; however, residents allege that no substantive action was taken despite repeated complaints.
Ms Sandhaya Bawankule ordered a Section 83 Enquiry based on the SGM, but the same is surely getting managed once again through her senior, Mr Abhijit Patil, under an appeal from MC Members, trying to continue the business of hiding
What lies ahead in the Kanakia Paris case

Treasurer Sundeep Dhargalkar is manipulating everything in sight, right from Papers to parking. So much so that he is administering toxins in water tanks to suppress contamination. All accomplices are beneficiaries of illegal parking engineered with the help of doctoring. Sundeep accepted the handover from Builder as the ex-Chairman of Society, and now moved closer to funds as Treasurer.
Much more is being further investigated by Authorities, including but not limited to Police, MPCB, BMC, Collector, Registrar under Section 78A and Section 83, etc., subject to investigations that are not influenced by Builders and Bureaucrats. One such bureaucrat stays in Kanakia Paris, whose spouse is on the board of directors of developers’ companies, clearly in conflict of interest with civil duties.
