A detailed Right to Information application seeking financial records of Shivkrupa Co-operative Credit Society Ltd. for the past 15 years has raised questions regarding loan waivers, donations, software procurement and lending practices. The request has been submitted before the District Deputy Registrar of Co-operative Societies, Mumbai City-1.
The Shivkrupa Co-operative Credit Society case has attracted attention within Maharashtra’s co-operative sector after a comprehensive RTI application sought access to financial and administrative records covering more than a decade of operations.
According to the application, Shivkrupa Co-operative Credit Society Ltd., bearing Registration No. B.O.M./RSR/S/1862-1982 may face detailed scrutiny of its financial transactions from the financial year 2009-10 onwards.
The RTI application was filed by Sudhir Sharad Gujar, senior journalist and a well-known Right to Information activist. The request has been submitted before the District Deputy Registrar (DDR), Co-operative Societies, Mumbai City-1.
The application seeks certified copies of records relating to loan disbursements, loan write-offs, donations, software purchases, maintenance contracts and other financial decisions taken during the last fifteen years.
The matter has generated discussion within the co-operative sector because the requested records cover significant areas of governance, financial accountability and regulatory compliance under the Maharashtra Co-operative Societies Act, 1960.
RTI Application Seeks Detailed Financial and Administrative Records
According to the RTI application, one of the principal areas of inquiry concerns loan waiver and write-off decisions undertaken by Shivkrupa Co-operative Credit Society during the past fifteen years.
The applicant has requested details of loans that were either fully or partially written off, the legal provisions under which such decisions were taken, and the board resolutions approving them.
The RTI application also seeks information regarding loans allegedly granted to present or former members of the Board of Directors and their relatives, along with details of outstanding dues and guarantors.
Another significant area of inquiry relates to donations made from the institution’s profits or reserve funds. Year-wise details of contributions to political, social, educational or charitable trusts have been requested.
Certified copies of Annual General Meeting resolutions approving such donations have also been sought to verify whether the decisions complied with applicable regulatory and governance requirements.
The applicant has additionally sought records relating to Core Banking Software procurement, installation, upgrades and Annual Maintenance Contracts, including tenders, quotations, invoices and vendor-related documentation.
Maharashtra Co-operative Societies Act and BNS Provisions Referenced
The RTI application cites provisions of the Maharashtra Co-operative Societies Act, 1960, particularly Sections 32, 79 and 81, which relate to governance, reporting and audit obligations applicable to registered co-operative institutions.
According to the application, audit reports, annual financial statements, expenditure records and loan approval procedures are required to be maintained and submitted to the competent authorities as prescribed by law.
The representation further notes that if any financial irregularities are ultimately established through documentary evidence, appropriate legal action may be sought under applicable laws.
Reference has also been made to provisions of the Bharatiya Nyaya Sanhita, 2023, including Section 316 relating to criminal breach of trust, Section 318 concerning cheating, and Sections 336 and 340 dealing with forgery-related offences.
However, the application itself does not allege proven wrongdoing, and any findings regarding financial irregularities would depend entirely on official records, audits, investigations and legal proceedings, if any.
